Govt plans to abolish upper age limit on jurors, allow only female to take part in selection
LONDON, 11 July “ British ministers want to take a leaf out of the US president Donald Trump's book and abolish the age limit for jurors in the Supreme Court by abolishing the upper limit on the number of jurors that can sit together on the bench. The move, proposed by Attorney General Jeremy Wright in his first public speech since becoming home secretary, comes two days after the election of the president in the United States and five months after the death of US Supreme Court Justice Louis Brandeis. The idea, said a government spokesman, was based on the US Supreme Court's decision in 1989 to exclude the jury in several civil cases from deliberations, after a Virginia judge ruled that the defendant and defense attorney did not adequately explain their case. The government intends to ask the government judge in the case, the South Wales County Crown Court, not to allow a second witness in his deliberations, allowing women and older members of the jury to represent the defendant. That change will, officials plan, ensure that the ruling is followed by Britain's judiciary and can be changed at the lower judicial levels. There is no suggestion that women are currently eligible for jury duty because of the lower number of jurors. Mr Wright, a veteran of the British public service for 36 years, spoke of "the importance of the role of women in the court and the importance of maintaining a high level of commitment on their part to that role". 'Good for society' Mr Wright spoke of the "benefits" of removing the age limit for jurors, saying: "The fact that the highest court in the land doesn't allow women to sit alongside the men does represent an important improvement for society. We should think about ways to encourage those around us who believe women's rights can't be guaranteed to give this new direction to that commitment." Mr Wright urged judges to be vigilant as to whether they are not being swayed by "disturbing media articles, and reports about a decision that many of us have seen". He pointed out that the court, with 12 female judges, was only now taking its judicial position under scrutiny by Labour Justice and Public Accounts Committee chairman Lord Justice Leveson.
Mr Wright said his department's proposals would not change the current process of removing judges from the bench, a procedure that was subject to appeal. That process, the first in UK law, was agreed by the Lords in 2007, by Commons approval in 2001, and then approved by parliament in 2010, after years of negotiations. The proposals would, however, allow judicial candidates to sit on the bench as if they were men but are no longer able to take part in proceedings at Westminster's Supreme Court.
